Terms of Service

These terms govern your use of the NativeAtlas platform (the “Service”), operated by [legal entity name] (“we”, “us”, “our”). By creating an account or using the Service, you agree to these terms.

1. Account and eligibility

  • You must be at least 16 years old, or have parent/guardian consent.
  • You are responsible for keeping your credentials secure and for all activity under your account.
  • One natural person per account. Don’t share logins.

2. Acceptable use

You agree not to:

  • Submit false, misleading, or fabricated sighting data.
  • Upload media you don’t have the right to share, or media depicting unlawful activity.
  • Scrape, crawl, or otherwise systematically extract data from the Service without prior written permission.
  • Attempt to bypass authentication, rate limits, paywalls, or security controls.
  • Use the Service to harass, dox, or threaten any person.
  • Disturb wildlife or breach federal/state laws (e.g. Environment Protection and Biodiversity Conservation Act 1999) when collecting sightings.

We may suspend or terminate accounts that violate these rules, with or without notice.

3. Content and licensing

You retain ownership of any content you submit (sightings, photos, audio, notes). By submitting, you grant us a worldwide, non-exclusive, royalty-free licence to host, display, transmit, and (when you explicitly mark content as training data) use it to improve our species-detection models.

Some clubs publish their members’ sightings publicly under a Creative Commons licence. Your club’s settings control this. Check with your club admin if unsure.

4. Subscriptions and billing

  • Subscriptions renew automatically. You can cancel anytime from your profile; you keep access until the end of the paid period.
  • We offer a 30-day full refund if you change your mind, no questions asked.
  • Prices are AUD and include GST where applicable. Prices may change with 30 days’ notice.
  • Failed payments: we retry per Stripe’s smart-retry schedule. Subscriptions in arrears for >14 days are downgraded to read-only.

5. AI detection

Species identification provided by the AI models is indicative, not definitive. Always verify with field guides and expert review before publishing or relying on a result. We disclaim liability for misidentifications.

6. Availability

We aim for high availability but do not guarantee uptime outside any specific SLA you have contracted for. Scheduled maintenance is announced via email at least 48 hours ahead where possible.

7. Liability

To the maximum extent permitted by law, our total aggregate liability for any claim arising from your use of the Service is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) AUD $100. Nothing in these terms excludes consumer guarantees that cannot be excluded under the Australian Consumer Law.

8. Indemnity

You agree to indemnify us against losses we suffer because of content you submit that breaches a third party’s rights, or because of your breach of these terms.

9. Governing law

These terms are governed by the laws of New South Wales, Australia. Disputes will be resolved in the courts of that jurisdiction. Before commencing proceedings, both parties agree to attempt good-faith negotiation for at least 30 days.

10. Changes

We may amend these terms. Material changes will be communicated via email at least 14 days before they take effect; continued use after that constitutes acceptance.
